Understanding your obligations

As a lettings agent you have two choices, perform all your landlord checks yourself, or get someone to help. Doing it yourself means you will have to:

Screen all landlords against the UK Sanctions List.
Confirm ownership of properties to be rented and screen beneficial owners against the sanctions list.
Where companies or other legal entities are the landlords or owners confirm the ultimate beneficial owner (UBO) and screening them.
Report any positive matches to the Office of Financial Sanctions Implementation (OFSI).

What are the new sanctions screening regulations and who do they apply to?

From 14 May 2025, letting agents will be required to conduct sanctions checks on both landlords and tenants for all UK rental properties. These checks must confirm that neither party is listed on the UK’s Consolidated List of Financial Sanctions Targets, maintained by the Office of Financial Sanctions Implementation (OFSI). The rules apply to new lettings, and agents must ensure they are not inadvertently facilitating transactions with sanctioned individuals or entities. If a person is found or suspected to be on the list, you must report this to OFSI and cease dealing with them.

When during the lettings process should sanctions checks be carried out?

Sanctions checks should ideally be carried out before a tenancy agreement is signed. For landlords, the obligation to report applies from the point they instruct the agent. For tenants, the obligation applies once an offer is accepted and the parties are “in the course of concluding” the agreement. Checking early helps avoid complications or delays.

Do the rules apply to tenants and landlords equally?

Yes – both must be screened. However, your obligation to report is triggered at different points depending on whether you are acting for a landlord (from instruction) or a tenant (once an offer is accepted).

If a tenant or landlord is already known to us, do we still need to screen them?

Yes – the regulations apply regardless of whether the individual is new or existing.

Do we need to check all existing landlords and tenants, or just new ones from 14 May?

Checks are required for new tenancies or clients from 14 May onward. There is no obligation to screen existing landlords or tenants retrospectively, unless a new tenancy agreement is being created.

What happens if a landlord gives a false name and is later found to be sanctioned?

Letting agents have a duty to verify the identity of landlords. If a false name is used and the individual turns out to be on the sanctions list, the agent could still be liable under strict liability rules. Verifying ID is crucial – even if AML checks aren’t triggered.

Are checks required for landlords with properties held in a company name?

Yes. If a property is owned by a corporate entity agents should identify and screen directors, shareholders, and persons with significant control to ensure no designated persons are involved.

Do I need to understand ‘beneficial ownership’ in this context?

Yes. You are required to understand who ultimately owns or controls the property. Identifying beneficial owners is a key part of compliance, especially when dealing with companies or trusts.

Which sanctions lists do we need to check? Just the UK, or international ones too?

You are legally required to check against the UK’s official Consolidated Sanctions List (https://www.gov.uk/government/publications/financial-sanctions-consolidated-list-of-targets).

Is there an obligation to carry out ongoing checks after a tenancy has started?

No formal requirement exists for ongoing monitoring. However, if you become aware that a tenant or landlord is sanctioned during the tenancy, you must report this to OFSI and cease dealing with the individual.

What should I do if I get a potential match on the sanctions list?

Pause the transaction and report it immediately using OFSI’s and cease any activity involving that person.

Are there penalties for non-compliance?

Yes. OFSI can impose significant civil penalties for breaches – even if they were unintentional. Strict liability means you can be fined even if you were unaware the person was sanctioned.

What records do I need to keep?

Keep records of all checks carried out – who was checked, when, what method was used, and the result. These records should be retained available for inspection.

Is this related to Anti-Money Laundering (AML) obligations?

Not directly. Sanctions screening is separate from AML, though both are part of broader compliance. Even if you are not subject to AML supervision, as a lettings agent you are still be subject to financial sanctions obligations.
